JOHNSON BANK AGREEMENT TO ACCEPT ELECTRONIC STATEMENTS

This Johnson Bank Agreement to Accept Electronic Statements (“Agreement”) applies to deposit and loan accounts (“Account”) established by you with us at this time and at any time in the future. In this Agreement, the terms “you” and “your” refer to each depositor or borrower, and the terms “we”, “us” and “our” refer to Johnson Bank (“Bank”). A “business account” includes all accounts other than a consumer account. A “consumer account” means the owner(s) is a natural person and the account is established primarily for personal, family or household purposes.

This Agreement incorporates by reference, the deposit account signature card or loan agreement executed at the time the Account(s) affected by this Agreement was opened, and the Bank’s Deposit Account Disclosures and Agreement (DADA) as amended from time to time. This Agreement also supplements the terms and conditions that apply to Johnson Bank Electronic Banking (”eBanking”), which are set forth in a separate agreement which you have agreed to by your enrollment in eBanking.

ELECTRONIC STATEMENTS SERVICE

By electing to receive Johnson Bank Electronic Statements (“Electronic Statements”), you will receive statements for eligible accounts in eBanking. Your Electronic Statement(s) may be accessed only by logging into eBanking. Electronic Statements will be available within 2 business days following the statement date. Electronic Statements are available for up to 84 months of history. For record‐keeping purposes (and to save statements exceeding 84 months) you may save your Electronic Statements to a folder on your computer.

When you elect to receive Electronic Statements, you will no longer receive paper statements via U.S. mail for all accounts you have selected or that are listed in detail on your combined statement. You as primary or secondary account holder are solely responsible for prompt and timely sharing of any Electronic Statement or statement‐related information provided thereon with any additional joint Account holder(s).

To view your combined statements online, the primary account must be selected from the list. Your primary account is the first account presented on your combined statement.

Except as otherwise required by law, all Electronic Statements shall be considered correct, and all items listed on the Electronic Statements shall be considered properly charged to an Account, unless you notify us of an error. All Electronic Statements must be examined by you promptly upon receipt. If your account is a consumer account, a reasonable time is not more than 30 days; if your account is a business account, a reasonable time is not more than ten (10) days. The date your statement is made available online will be deemed the date of receipt of your Electronic Statement. You must also notify us of any other account problem, including an erroneous statement, unauthorized or missing endorsement or improper charges within 30 days of the date we send or make available to you your statement or checks.

We will notify you by email when your Electronic Statement(s) is made available.

ELECTRONIC STATEMENT SERVICE APPLICABILITY TO BUSINESS ACCOUNTS

Notwithstanding anything to the contrary herein, you understand and agree that, to the extent legally permitted, business accounts are automatically enrolled to receive Electronic Statements, and may not withdraw enrollment or consent to receive Electronic Statements. Paper statements may be made available at a cost, upon request. A “business account” includes all accounts other than a consumer account. A “consumer account” means the owner(s) is a natural person and the account is established primarily for personal, family or household purposes.

HARDWARE AND SOFTWARE REQUIREMENTS

In order to access, view and retain Electronic Statements, you must have a personal computer, operating system and telecommunication connections to the Internet capable of receiving, accessing, displaying and either printing or storing Electronic Statements you receive from us by access to our web site using the technology specified below:

By reading and accepting this agreement, you acknowledge that you have a current version of Adobe® Acrobat® Reader® (you may download the most current version at get.adobe.com/reader to access and read communications). You also acknowledge that you have the ability to open PDF files that we deliver to you and further agree that you would like to continue the Electronic Statement activation and no longer receive paper statements.

CHANGES TO HARDWARE AND SOFTWARE REQUIREMENTS

We will provide you with notice of any change in the hardware and software requirements in order to access, view and retain Electronic Statements. Your decision to continue to receive Electronic Statements will constitute your agreement to any such changes.

UPDATING YOUR RECORDS

It is your responsibility to provide us with an accurate and complete email address, contact and other information related to this Agreement and your Account(s). You must promptly update this information when it changes. You can update your email address, change your statement delivery method, and make changes to information such as your mailing address or phone number by accessing your eBanking account. We may send you requests through your eBanking service asking you to verify the accuracy of your email address which will assist us with maintaining updated contact information.

REQUESTING PAPER COPIES

To request a printed paper statement, contact a Bank representative or the Johnson Financial Group Customer Support Center at 1.888.769.3796. A fee of $10.00 may be assessed.

WITHDRAWAL OF YOUR CONSENT TO RECEIVE ELECTRONIC STATEMENTS

For consumers your ongoing consent to receive Electronic Statements is voluntary and may be withdrawn at any time. You may withdraw your consent by accessing your eBanking account and making the requested change. Alternatively, contact the Johnson Financial Group Customer Support Center at 1.888.769.3796, send an email to jcsc@johnsonfinancialgroup.com (not a secure email facility), or mail your request to Johnson Bank, 555 Main Street, Suite 390, Racine, WI, 53403. By withdrawing your consent to receive Electronic Statements, you may not be able to access statements previously made available to you online and will again begin to receive paper statements via U.S. mail. If you withdraw your consent to receive Electronic Statements, the withdrawal will become effective after your request is processed (not to exceed one statement cycle).

APPLICATION OF FEDERAL LAW

You acknowledge and agree that your consent to receive statements electronically is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (ESIGN), and that you and we both intend that the Act apply to the fullest extent possible to allow us the ability to conduct business with you by electronic means.

CHANGES/TERMINATION

We reserve the right, at our sole discretion, to change or terminate the terms and conditions under which we provide statements electronically, or to discontinue providing statements to you electronically. We will provide you with advance notice of any such change or termination. Your decision to continue to receive statements electronically will constitute your agreement to any such changes.

ACCEPTANCE OF THIS AGREEMENT

By accepting this Agreement, you acknowledge your understanding of, and agreement to these terms and conditions. You also confirm that you are able to meet the hardware and software requirements necessary to access, view and print Electronic Statements.

PLEASE PRINT A COPY OF THIS AGREEMENT FOR YOUR RECORDS BY RIGHT CLICKING WITHIN THE DOCUMENT AND CHOOSING THE PRINT OPTION.

PLEASE NOTE: Once you accept the Johnson Bank Agreement to Accept Electronic Statements/eStatement Disclosure you are immediately enrolled in Electronic Statements. Consumers can proceed with selecting and viewing statements. Business customers can proceed with viewing statements.
